Haya Rashed Al Khalifa wins a complex dispute resolution case
Haya Rashed Al Khalifa wins a landlord and tenant dispute case on 22 Dec 2016. The Rent dispute resolution case was brought against our client to claim for outstanding rent payments. Our legal principle was based on the doctrine that although the limitation period in rents falls after a lapse of five years, whereby, this period does not begin from the date of expiry of contract, but it commences from the date of maturity of the debt. Accordingly, the Court affirmed the dismissal in favor of our client.
أقيمت هذه الدعوى بمطالبة إيجارات متخلفة وقد تم تأسيس مبدأ قانوني مؤداه أن مدة التقادم في الإيجارات وأن كانت تسقط بمضي خمس سنوات إلا أن هذه المدة لا تبدأ من تاريخ إنتهاء العقد وإنما تبدأ من تاريخ إستحقاق الدين ، وقد حكمت المحكمة بناءاً على ذلك برفض الدعوى لصالح موكلنا.
